Disciplinary Appeal:

At the request of parents, Aseel Alsahhaf and Ali Alsinayyid, the disciplinary appeal of their son, Mohamed Aisinayyid, will not be conducted in Executive Session and will be held in open meeting.  Further the parents agreed to the recording of the proceedings to ensure accuracy and of the representations made by all parties.

The parents made verbal presentations to the Board and submitted a letter (attached) to the members of the Board to appeal the results of the investigation conducted by Ms. Montierth regarding the disciplinary action imposed by the K-5 Student Support and Conduct Coordinator in which Mohamed Aisinayyid received 3 days of Out Of School Suspension (OSS) due to multiple occurrences of bullying behavior. As a result of her investigation, Ms. Montierth upheld the actions of the K-5 Student Support and Conduct Coordiantor.  The parents appealed specific portions of Presidio’s Principal’s disciplinary decision, specifically that their son receive 3 days of Out of School Suspension (OSS) sighting that the student handbook stated In-School Suspension (ISS) was what should have been imposed.  They originally did not want ISS imposed because they were under the impression that the In-School Suspension (ISS) would occur in the front office where their son would be “put on display.” thus negatively impacting his self-esteem. In addition to appealing the OSS, they requested the following:

  • An apology to Mohamed Aisinayyid from the K-5 Student Support and Conduct Coordinator for referring to him as a “bully,” as it negatively impacted their son’s self-esteem and confidence. The parents indicated that Mohamed’s behavior that led to the discipline was a result of retaliation that stemmed from bullying on the part of other students.
  • Presidio’s K-5 Student Support and Conduct Coordinator stated that the information he had received from teachers and peers indicated that Mohamed engaged in frequent bullying behaviors, often initiating bullying interactions.
  • A whole class discussion, facilitated by Mohamad’s current teacher, about the negative effects of bullying, including a directive from the teacher to the class to “stop bullying” Mohamad.
  • A change in Student Support and Conduct Coordinator and teacher.
  • The Principal previously offered to change Mohamed’s homeroom teacher, but reminded the parents that because fourth grade team teachers, he would still have his current homeroom teacher for ELA.  At that time, the parents opted not to change teachers.

At 6:31 PM the Presidio School Board of Directors went into Executive Session to consider the verbal and written information provided by parents, Aseel Alsahhaf and Ali Alsinayyid, and a recorded message from Mohamed Aisonayyid; the K-5 Student Support and Conduct Coordinator’s statements; the disciplinary history of Mohamed Aisonayyid; and the written investigation documents prepared by Ms. Montierth.

At 6:56 PM the Presidio School Board of Directors came out of Executive Session and presented the following motion with regards to the disciplinary action imposed upon Mohamed Aisinayyid.

Motions:

  1. To approve a change to the disciplinary action imposed on Mohamed Aisinayyid to include the following: The OSS is to be removed from the student’s record and replaced with ISS, as ISS was the appropriate consequence according to the Student Handbook; The Student Support and Conduct Coordinator will have a conversation with Mohamed to clarify any misunderstandings about ISS and OSS, but would not apologize for providing discipline; Mohamed as well as his fellow classmates will participate in a Brain Health Bootcamp Lenny Llama Lesson about bullying; upon completion of the lesson and as part of ISS Behavior Contract, Mohamed will be tasked with conducting a lesson in bullying for a lower grade level (kinder or first) to demonstrate his understanding of the material and in an effort to increase his confidence and self-esteem; Mohamed’s homeroom teacher will be changed and he will be assigned to an alternate Student Support and Conduct Coordinator who will work with Mohamed to finalize a Behavior Contract to include at a minimum the bullying lesson and subsequent presentation.
